Visitors use www.UpNextDestinations.com (the “Website”), including all subdomains, of their own free will. By using the Website, they agree to comply with all of the terms and conditions outlined below.

A link to these terms and conditions has been made available on every page on the website. Failure to read them does not absolve any visitor to the website of the requirement to abide by them. Use of the website shall be understood as agreement with them. 

Real talk: We live in a frustratingly litigious society. We protect our company’s interests by requiring you to comply with the below while, and in conjunction with, viewing our website. In exchange, you get to both learn about how we can help you plan awesome trips as well as read all the FREE stuff that we have posted! 


The Website and the content therein are provided on an "as is", "as available" and "with all faults" basis, and all use of the Website and the content is at your own risk. To the fullest extent permissible under applicable law, we make no representations or warranties of any kind, express or implied, regarding the site, the site content, or your access to or use thereof. We hereby disclaim any and all implied and statutory warranties of any kind.  We do not represent or warrant that the Website or the content will be accurate, complete, up-to-date, or reliable; that access to or use of the Website will be uninterrupted, secure, or error-free; that the Website, the content, or any portion thereof will not change or be discontinued; that errors or defects will be corrected; that the Website or the content will be free from computer viruses or other harmful components; or that access to or use of the Website or the content is lawful in any particular jurisdiction. No supplier to us has any warranty, support, or other obligations to you in connection with your use of the Website. If you are dissatisfied with the Website or the content, your sole and exclusive remedy is to discontinue using the Website. Under no circumstances shall we be liable for any indirect, incidental, consequential, special, exemplary, punitive, or other damages or losses of any kind arising out of or directly or indirectly related to the Website, the content, your access to or use thereof, our performance, non-performance, acts, or omissions in connection therewith, the privacy policy, or these terms of use, even if foreseeable, and even if we have been advised or should have known of the possibility of such damages.

The information provided on the Website is intended to be helpful for prospective customers of Up Next Destinations LLC (the “Company”) and for prospective visitors to our featured destinations. Visitors to our website, including our featured destination guides, visit of their own free will and are under no obligation to read, agree with, and/or act on any of the information or opinions that we share. Our featured destination guides are not intended to be comprehensive, but rather solely to provide select opinions to prospective travelers at our own and full discretion. Our preferences and opinions may differ from other individual’s and/or company’s opinions with regards to a destination as a whole and/or to particular activities and/or suppliers.

In addition, the Company is not responsible for any harm or loss that may befall visitors to our website while visiting featured destinations, engaging in activities, and/or consuming products or services described/discussed on the Website.

Similarly, the Company is not responsible for any harm or loss that a visitor experiences as a result of information on the Website being inaccurate or out-of-date. It is the visitor’s responsibility to verify relevant information, including addresses, opening hours, and prices, directly with each supplier before visiting and/or purchasing goods and/or services from the supplier.

The Company takes privacy seriously. That said, and for the avoidance of doubt:

  • We do use cookies on the Website, as and for the reasons described below.

  • We do allow third party advertisers to collect certain non-personally identifiable information from visitors to the Website, as and for the reasons described below.

We do not collect any additional information, including any personally identifiable information, from our visitors, except for information shared directly and voluntarily by visitors (such as, and including but not limited to, information shared via email or the contact form).

The Company reserves the right to use information shared voluntarily by visitors for purposes related to providing goods or services materially similar to those advertised and described on the Website to the visitor, as well as to protect the interests and well-being of the Company and its employees, partners, and suppliers (including, but not limited to, reporting threatening communication and/or harassment).


The Website uses cookies. Cookies are small text files placed on a visitor’s computer, tablet, phone, or other device in order to optimize user experience while on our website. Cookies facilitate this by collecting and storing user preferences, as well as by providing non-personally identifiable data to applications such as Google Analytics (which in turn allow us to further optimize our site).

We draw attention to the fact that we use cookies by placing a banner on the bottom of the screen when visitors access our homepage. If visitors do not want us to collect cookies during their visit to our website, they may disable cookies in their browser.

Text and images on the Website are the property of the Company. No text or images may be copied, reproduced, repurposed, or otherwise used without our express, written consent. We have secured permission to use any images that we did not create ourselves. Visitors may not use them without the express, written consent of their owner.

Real talk: Don’t take anything without asking us. If there’s something that you want to use, please ask us and secure our permission first.


The Company reserves the exclusive right to modify any aspect of our business, services, website, and/or website terms and conditions if/as/when we see fit, and to do so without providing advance notice to any other parties.


The Company allows third parties to place advertisements on the Website. The Company is neither responsible nor accountable for the products, services, and/or messaging of the third party advertisers. Visitors consume the third party advertiser’s products, services, and/or messaging at their own risk, and agree not to hold the Company liable for any harm that befalls them wile consuming any third party’s products, services, and/or messaging.

We allow third parties to collect certain non-personally identifiable information from visitors to the Website. The third parties are permitted to use such non-personally identifiable information during a visitor’s visit to the Website in order to increase the likelihood that the advertisements that they place are about goods and services relevant to the visitor.

Real talk: We make a LOT of content available for free. It took us a lot(!) of time, effort, and money to produce that content. And it continues to cost us money to keep it available. The revenue that we generate from the advertisements that we place offsets only a fraction of all of the costs associated with drafting, posting, and hosting all of that free content.


The Website contains links to other websites. We provide these links for visitor’s further edification and/or convenience. We are neither responsible nor accountable for the content or terms and conditions (including but not limited to the privacy policy) of any other website, including of websites that we link to on our website. Some of the external links are affiliate links (see the next section below for more about affiliate links).

Real talk: The Internet is dark and full of terrors. You’re on your own outside of our website.


In layperson’s terms, an affiliate link is a link to a third party’s website (either a provider of a product or service, or a platform on which multiple providers sell their products and/or services) that identifies the visitor as arriving to the website from a particular source (usually another website).

We embed affiliate links in our featured destination guides, blog posts, and email communication. If visitors click on an affiliate link and then purchase the third party supplier’s product or service, we will receive a small commission (paid by the third party supplier or platform). Visitors will not be charged an extra fee or inflated price because they made their purchase after clicking on an affiliate link.  

Real talk: We make a LOT of content available for free. It took us a lot(!) of time, effort, and money to produce that content. And it continues to cost us money to keep it available. The revenue that we generate from the affiliate links that we embed offsets only a fraction of all of the costs associated with drafting, posting, and hosting all of that free content. So we ask that if you book a product or service (such as a hotel room) that we recommend, and don’t plan on using the Company’s services to do so, please consider clicking directly through our affiliate link when purchasing!


Up Next Destinations occasionally sends out email newsletters. We send email newsletters to email addresses that we have on file. The email addresses that are in our file are in our file either because someone contacted us about our services, or because someone explicitly asked us to include them on future email newsletter distribution (via an enrollment option in our website’s footer). All email newsletters that we send out contain an unsubscribe option in the footer of the email. Click on that and our newsletter software will remove that email address from our distribution list for all future email newsletters.

Real talk: As an avid inbox zero-er, I agree that most of us get wayyy too many emails. So if you no longer want to receive our email newsletters, you’ll always have the opportunity to unsubscribe. That said, we will be sorry to no longer be able to share exciting updates, discounts, and insider travel tips with you via email.


The Website may include opportunities to view information and communicate with us through social media services such as LinkedIn®, Twitter®, Facebook®, Glassdoor®, and blogging. You should use common sense and good judgment in communicating with us through these services. We are not responsible for the terms of use and privacy policies that govern these third party sites.


We try hard to keep our website up-to-date. However, sometimes suppliers that we detail/discuss in our featured destination guides close, change their address, alter their opening hours or offering, and/or adjust their prices in between updates. The Company is not responsible for any such changes. That said, if a visitor notices any, we would be most grateful if they would Contact Us and let us know.

All opinions expressed on the Website are exclusively the opinions of the Company. We are infrequently provided with free or discounted goods and/or services from suppliers. However, the opinions expressed on the Website do not depend in any way on discounts or gifts from suppliers. Moreover, we do not accept payments, including free or discounted services, from suppliers in exchange for writing positively about them.

All of the following activities are expressly prohibited with regards to the Website:

  • Article spinning

  • Data extraction, harvesting, and/or mining

  • Framing

  • Scraping


Any waiver by us must be express and in writing, must be directed specifically by us to you, and must be signed by our duly authorized representative. Our failure to enforce any provision of these Terms of Use or to respond to a breach by you or third parties shall not in any way limit or waive our right to do so, including without limitation our right to enforce subsequently any provision of these Terms of Use, or to assert our rights with respect to the same or similar breaches.


Unless otherwise specified herein, these Terms of Use and the Privacy Policy incorporated herein constitute the entire agreement between you and us with respect to the subject matter hereof, and supersede all prior and contemporaneous agreements and understandings, whether written or oral, concerning the subject matter hereof. Any conflicting or supplementary terms proposed by you in any e-mail or other communication shall not be binding on us, and are hereby objected to and expressly rejected.


These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to principles of conflicts of law. All visitors submit to and consent to the jurisdiction of the State of Florida, and agree that any dispute, claim, action, or proceeding relating to or arising out of the Website shall be conducted in the courts of Miami-Dade County, Florida or the federal courts for the United States for the Southern District of Florida. The Website is intended for use by individuals residing in the United States of America. No laws of any foreign jurisdiction shall apply to these Terms of Use or be binding on the Company.


If any portion of these Terms of Use or the Privacy Policy is held invalid or unenforceable under applicable law, that portion shall be construed in a manner consistent with applicable law to accomplish, as nearly as possible, the objective thereof, or severed from the document if and solely to the limited extent such construction is not possible, and the remaining portion of these Terms of Use and the Privacy Policy shall remain in full force and effect.
